This action was instituted in the district court of Osage county by the state of Oklahoma on the relation of Charles L. Roff, county attorney of Osage county, to test the right of the plaintiffs in error to exercisej the functions of the office of members of the board of education of the independent school district of the town of Foraker, Osage county, state of Oklahoma..The facts, as disclosed by the record, show that in 1921 a union graded school district was created, being composed of school districts No.-5 and 10, one of which' originally included the town of Foraker,…
