This is an appeal from a judgment for $3,500 rendered by the superior court of Cook county against the defendant railway company in an action for damages for negligently causing the death of Frederick Runge,. plaintiff’s intestate, on or about August 9, 1917. The cause was tried before a jury. At the conclusion of plaintiff’s evidence and again at the conclusion of all the evidence defendant moved for a peremptory instruction finding the defendant not guilty.
