This was an action of replevin in the district court of Gage county. George W. Earle was plaintiff, and one George *703Noll, a constable, was defendant; the property replevied, a stock of drugs, medicines/ and fancy articles, such as are usually kept in a drug store. There are two lengthy abstracts in the case in this court; but I will state the facts ■of the case, as I understand them, after a careful examination of both, and frequent recurrences to the transcript, without specially following either.
