This matter comes to us on appeal from a judgment of the civil district court dismissing, on exception of no cause of action, a suit for damages for alleged unlawful death brought against various defendants, including the ex-ceptor, Louisiana highway commission.

The sole question now before us is whether such commission, an agency or department of the state, may be sued for damages ex delicto.
