This appeal raises a question of a patent licensee’s standing to sue an infringer in the name of the patenteeAicensor. Ortho Pharmaceutical Corporation is a licensee of Am-gen, Inc., owner of United States Patent No. 4,703,008 (the ’008 patent). Ortho and its sublicensees filed suit against Genetics Institute for infringement of the ’008 patent in the District Court for the District of Massachusetts.
