MEMORANDUM OPINION AND ORDER

HOOD, District Judge.

This matter is before the Court upon the motion of the defendant, Wal-Mart Stores, Inc. (Wal-Mart), for summary judgment. The plaintiff, Mary F. Stump (Stump), has Sled a response to which Wal-Mart has replied.

In addition, Stump has filed a motion for partial summary judgment. Wal-Mart has responded incorporating the arguments set forth in the memorandum in support of its motion for summary judgment.
