HAND, Senior District Judge.
This action is before the Court on plaintiffs motion to remand (Doc. 3), as supplemented (Doc. 6), and motion for leave to amend (Doc. 8), as supplemented (Doc. 12). Inasmuch as the removal of this action from the Circuit Court of Marengo County, Alabama, was predicated on the alleged fraudulent joinder of the resident defendant Rahal Buick, Inc. (Rahal), and because the motion to remand specifically addresses Rahal’s right to summary judgment as a matter of law, the Court will also consider at this time the pending motion for summary judgment filed by Rahal…
