MEMORANDUM DECISION

GORDON THOMPSON, Jr., District Judge.

This is an action for declaratory and injunctive relief against the sheriff of Imperial County and three of his deputies. The defendants have moved to dismiss the complaint on the ground that the complaint fails to state a cause of action, and have submitted affidavits and exhibits in support thereof. Accordingly, pursuant to Rule 12(b), F.R.Civ.P., this motion will be treated as one for summary judgment under Rule 56.
