We are concerned in this case with whether the law officer erred to the prejudice of the accused by receiving into evidence Prosecution Exhibit 1. The exhibit is the deposition testimony of Private Geddes, a prosecution witness to the events set forth in the specifications of Additional Charges I and II — sodomy and assault with intent to commit sodomy, Articles 125 and 134, Uniform Code of Military Justice, 10 USC §§ 925 and 934, respectively.
