Martin, J.:
The. plaintiff sued for an absolute divorce, and applied to the court for a counsel fee to pay her attorney. By an order dated May 23, 1924, the court granted the application.
Prior to the entry of that order defendant applied for an order directing a jury trial of the charge of adultery through framed issues. The issues so framed were directed to be tried before a jury on June 6, 1924. The defendant expected the case to appear for trial on that day but knew he could not proceed because of a clause in the order of May 23, 1924, which granted the plaintiff’s original application for…
