MEMORANDUM OPINION
FLANNERY, District Judge.
This matter comes before the court on defendant’s motion for retaxation of costs. Defendant, Jurid Werke GmbH (“Jurid”) seeks review of the taxation of costs set by the Clerk on May 26, 1982 and retaxation of costs in accordance with defendant’s original request.
This matter arises out of an unsuccessful complaint filed by plaintiff, Hans Oetiker (“Oetiker”), against defendant alleging fraudulent procurement of a patent in violation of section 2 of the Sherman Act, 15 U.S.C. § 2. On May 5, 1980, a trial began on the issue of patent fraud. The trial…
