MEMORANDUM OPINION

OSTEEN, District Judge.

This matter is before the court pursuant to Defendant United Parcel Service, Inc.’s, (UPS) Motion for Summary Judgment. Plaintiff Turner O. Wiley originally filed this action in state court alleging that UPS terminated him and failed to reinstate him in retaliation for having filed workers’ compensation claims in violation of the North Carolina Retaliatory Employment Discrimination Act (REDA), N.C.GemStat. § 95-241 et seq.
