On November 10,1928, a head-on collision occurred between plaintiff’s automobile driven by himself and a street car of defendant on Tower avenue in Superior, Wisconsin. Plaintiff recovered a verdict for damages. Defendant made- a motion for judgment notwithstanding the verdict, and, in the event that it should be denied, made a motion for a new trial. The motion for judgment was denied. The motion for a new trial was granted unless plaintiff filed a written consent to reduce the verdict to the sum of $8,800, in which event the motion for a new trial was denied. Plaintiff filed the…
