This is an action of tort, to recover damages for personal injuries sustained by the plaintiff when she fell *426down a stairway in the early evening of May 2, 1941, as she was leaving the apartment of her daughter Mrs. Murphy, with whom she had made a social visit. Mrs. Murphy and her husband, together with their family, since 1935 had occupied this apartment, which was located upon the second floor of a building owned by the defendant.
