The plaintiff, Stewart Moscoviteh, individually and as administrator of Nitai Moscov-iteh’s estate, brought this action in the Connecticut Superior Court against the defendants Danbury Hospital, Vitam Center, Inc. (“Vitam”) and Physicians Health Services, Inc. (“PHS”). The defendant PHS removed the case to this Court pursuant to 28 U.S.C. §§ 1441(a) and (b) (1994), asserting that the complaint contains claims arising under federal law to recover benefits due under a health care plan governed by the Employee Retirement Income Security Act of…
