This is an appeal from a judgment in favor of respondent after trial before the court without a jury in an action to recover the value of a diamond brooch delivered by appellant to respondent for the purpose of supplying a. small diamond which was missing therefrom.

Appellant, a retail jewelry concern, received from one of its customers a diamond brooch from which a small diamond had been lost.
