Board of Regents v. Wilson
Appellate Court of Illinois
1Opinion of the Court
Mr. PRESIDING JUSTICE THOMAS J. MORAN
delivered the opinion of the court:
This is an interlocutory appeal by defendants, Miller-Davis Company and its sureties, who are joined as defendants under their performance bonds wherein they guaranteed plaintiff that Miller-Davis would well and truly perform the work of erecting certain buildings according to the terms and specifications of the contracts. They appeal from the trial court’s denial of their motion to dismiss plaintiff’s complaint against them. This appeal is pursuant to Supreme Court Rule 308. (Ill. Rev. Stat. 1973, ch. 110A, par. 308.)…
