The ultimate question for determination on this appeal concerns the title to underwater land at the southern end of Cold Spring Harbor, in the area known as the inner harbor. Cold Spring Harbor is a navigable body of water which extends southerly from Long Island Sound, for about five miles into northern Long Island. The upland to the west lies in the defendant Town of Oyster Bay, Nassau County, and the upland to the east lies in the defendant Town of Huntington, Suffolk County.
