Greene, J.:

James Paxton was the occupant of the ' northeast quarter of section 26, township 30, range 1 east, in Sumner county, Kansas. The right of way of the Atchison, Topeka & Santa Fe Railway Company, which runs in a northeasterly direction over this land, is fenced. The Paxton residence is on the southeast corner of the farm, and across the right of way is a pasture. Between the residence and this pasture a private crossing and gates are maintained by. the railroad company for the accommodation of the occupants of the farm. The fastening to the…
