This suit was brought by the appellee for a peremptory mandate, to compel the appellant to levy a tax, which it was alleged had been voted by the people of Crawford county to aid in the construction of appellee’s road, by taking stock therein, underact of May 12th, 1869. .

It will be a sufficient statement of the complaint to say it showed that all of the preliminary steps had been properly taken, including the vote and its proper return, showing a majority of forty-four votes for the appropriation, in December, 1869; that at the regular June session of 187CJ, the appellant had been requested…
