From Bartholomew Circuit Court; F. T. Hord, Judge. Action by the board of trustees of the school town of Crothersville against John Krause and others. From a judgment for plaintiff, defendants appeal. Transferred from Appellate Court, under subdivision 2, §1337j Burns 1901.

This suit was instituted by appellee to recover on a bond executed by appellants for the faithful performance of a building contract. Certain of the appellants, constituting the firm of John Krause & Co., filed a cross-complaint to recover for a balance unpaid under the contract, and to this they added a paragraph on a quantum meruit. Issues were joined on the pleadings mentioned, and a trial resulted in a judgment in favor of appellee upon its complaint, and against said cross-complainants, on the issues tendered by them.
