Defendants Elliott Travel & Tours, Inc. and Jared Schubiner appeal the district court’s grant of summary judgment for the Secretary of Labor in this action brought for violation of the Fair Labor Standards Act (“FLSA”), 29 U.S.C. § 201 et seq. The principal issues on appeal are (1) whether there is a genuine issue of material fact as to Schubiner’s status as an “employer” under the FLSA, 29 U.S.C. § 203(d); (2) whether there is a genuine issue of material fact as to the defendants’ willfulness in violating the FLSA; (3) whether the district court erred by awarding…
