On March 15, 1983, after protracted litigation, the Patent and Trademark Office issued United States Patent No. 4,376,851 (“ ’851”) to Phillips Petroleum Company (“Phillips”). On the same day, Phillips filed the present action against United States Steel Corporation (“U.S. Steel”) for infringement of the patent. By letter dated March 15, 1983, Phillips offered several companies, including U.S. Steel, non-exclusive licenses relating to polypropylene at a specified royalty rate.
