STOKES, Justice.

This action was instituted by the appellant, Robert Sartain, against the appellee, G. W. Basinger, to recover damages for personal injuries sustained by appellant on the 18th of September, 1944. Appellant alleged that he was a minor of the age of 17 years and was employed by the appellee as an attendant at a gasoline filling station and garage owned and operated by appellee in the town of Southland in Garza County.
