A nonsuit was granted by the trial court in this case upon the grounds that no negligence on the part of the defendant company had been proved, and that plaintiff was guilty of contributory negligence, and upon this direction the writ of error now before us was taken. The plaintiff’s case presented the facts that he, a boy of fifteen years, had been in the defendant’s employ about five months flanging stays upon a small machine, which was not in constant use, and was movable from place to place in the factory.
