At the close of the evidence the defendant moved for a verdict on different grounds stated, among which were, that upon the whole evidence the plaintiff cannot recover, and that from the evidence he was guilty of contributing negligence, in that with the situation plainly before him he stumbled over a board or piece of lumber and fell against the machine,— the stumbling or falling being an act of negligence which due care would have prevented.
