The proper determination of each of these cases depends upon the validity or invalidity of thé “Act to organ- “ ize and maintain a system of public schools,” approved April 24, 1872, and the authority conferred thereby to collect the taxes brought in question in them. The constitutionality of this law and the liability of the tax-payers for these taxes, has been sustained by this court in the cases of Kinney v. Zimpleman (36 Texas, 554; Bremond v.
