Appeal from Travis. Tried below before the Hon. J. P. Richardson. Appellants in this case sought to enjoin the collection of the “ one per cent, school tax ” levied by the Board of Education of Travis county. The District Court dissolved the preliminary injunction granted to the plaintiffs, and dismissed their bill, from which judgment this appeal is prosecuted.

The appeal in this case is taken from a judgment of the District Court of Travis county, dissolving an injunction which restrained the defendant, G. B. Zimpleman, sheriff and ex-offioio assessor and collector of taxes for said *571county, from collecting what is commonly known as the one per cent, school tax.
We shall not notice, in their order, the assignments of error; but we shall consider the very important questions which are presented upon the record, and treated in the briefs as decisive of the case. It is necessary that we should give but a passing notice to the pleadings in the case; they…
