Appellant was indicted in the Circuit Court of Holmes County on a, charge of knowingly receiving certain stolen automobile tires in violation of Section 2249, Code 1942. He was convicted, sentenced to a term of three years in the state penitentiary, and appealed here.

The assignment of errors, among other grounds, includes complaints that the court erred in overruling appellant’s motions to exclude the State’s evidence at its conclusion; to give him a peremptory instruction at the end of all the evidence; and to grant him a new trial…
