MEMORANDUM OPINION

BRAMLETTE, District Judge.

This matter is before the Court on the Defendants’ (United States of America and Col. Gary W. Wright, sued in his official capacity) motion for dismissal or summary judgment pursuant to Rules 12(b)(6), 12(b)(1), and 56(b). The Defendants argue that the Court is without subject matter jurisdiction and that the complaint fails to state a claim upon which relief can be granted. Also before the Court is the plaintiffs motion for sanctions and attorney’s fees and the defendant’s motion for sanctions and attorney’s fees (docket entry nos. 35 and 37).…
