delivered the opinion of the court.. From the record in this case it appears that the Uncompahgre Canal Company, one of the appellees herein, spoken of in this opinion as “ The Canal Company,” was organized as a corporation under the laws of this state in May, 1883, for the purpose of constructing an irrigating canal in Montrose county, Colorado.
In September, 1883, Theodore C. Henry, being the president, and Henry J. Aldrich, the treasurer, of said canal company, entered into a contract with Joseph Williams, one of the appellants herein, whereby Williams agreed to construct…
