Appeal from a judgment of the superior court for Spokane county, Oswald, J., entered February 4, 1919, upon the verdict of a jury rendered in favor of the plaintiff, in an action for personal injuries sustained by an employee through contact with electric wires.

Respondent, at the time of receiving the injuries hereinafter referred to, was employed by the city of Spokane as a bridge carpenter, and was then engaged in the repair of a wooden bridge belonging to the city, which bridge carried the traffic of Sec*472ond avenue above and over the tracks of appellant. At the time when appellant constructed its tracks and strung its wires, there was no overhead crossing at Second avenue.
