The plaintiff by this action seeks to recover damages against the defendant railroad company for the death of his intestate, alleged to have been caused by the defendant’s, negligence. It is alleged, in substance, in the complaint that Leo Robinson, plaintiff’s intestate, on January 8, 1926, was. in the employ of the Christensen Construction Company and Working near “Devil’s Slide” in Morgan county leveling up the iron or steel rails then and there being laid by said construction company, for the uses and purposes of the defendant; that at said time and place there was an electric…
