PARKER, Circuit Judge:
On February 4, 2000, the government filed a motion to dismiss Defendant-Appellant Jose Gomez-Perez’s appeal in this case, arguing that Gomez-Perez had waived all rights to appeal so long as his sentence was within the range stipulated to in the plea agreement. On February 18, 2000, Gomez-Perez’s counsel notified this Court that she took “no position with respect to the government’s motion.” On March 8, 2000, this Court denied the government’s motion without prejudice, and it ordered briefing on the question of whether Gomez-Perez’s counsel should be required to submit a…
