DECISION ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

The matter before the Court is Ronald P. Compagnone’s Motion for Summary Judgment. For the reasons stated below, the motion is granted as to Counts I though V and denied as to Count VI.

I. Background

On January 19, 1999, Ronald P. Compagnone (the “Debtor” or “Defendant”) filed a voluntary petition under Chapter 7 of the Bankruptcy Code. At that time, the Debtor and his wife, Jane E.
