Plaintiff, Superior Concrete Accessories, Inc., (Superior), has taken this timely appeal from judgment determining that Patent No. 2,985,937 is invalid. Superior as owner of Patents No. 2,985,936, referred to as the ’6 patent, and No. 2,985,937, referred to as the ’7 patent, brought this action under the patent laws of the United States against defendant, Richmond Screw Anchor Co., Inc., (Richmond), seeking an injunction against the infringement of such patents and damages for infringement.
