Plaintiff Ford Motor Company has moved under USCIT Rule 59 for reconsideration (ECF No. 41) of the Court’s Final Order of July 22, 2010, and accompanying opinion, Ford Motor Co. v. United States, Court No. 09-00151, 34 CIT --, 716 F.Supp.2d 1302 (CIT 2010). The granting of a motion for reconsideration is within the sound discretion of the Court, and is typically granted only in the case of “an intervening change in the controlling law, the availability of new evidence, the need to correct a clear factual or legal error, or the need to prevent manifest injustice.”…
