Action for damages for personal injuries received by plaintiff, who, while riding a motorcycle, was struck by an automobile driven by defendant. From a judgment against him for the sum of three thousand dollars, defendant appeals.

Respondent moves the dismissal of the appeal upon the ground that the reporter’s transcript does not conform to rules 7 and 8 of this court and that the clerk’s transcript was not approved within the time prescribed by law. Although respondent’s motion to dismiss the appeal has been heretofore heard and denied, it is proper to say here that his objection is founded…
