OSG Bulk Ships, Inc. sued the United States, the Secretary of Transportation and the Administrator of the Maritime Administration (“MarAd”), seeking declaratory and injunctive relief with respect to the defendants’ interpretation of Section 506 of the Merchant Marine Act of 1936, 46 U.S.C. app. § 1156.
