W. Z. Thompson instituted this action against the Grand International Brotherhood of Locomotive Engineers, a corporation created under the laws of Ohio, the St. Louis, Southwestern Railway Company of Texas, and J. J. Bartholomew, W. H". McCorkle, G. L. MeCordel, M. M. Bartholomew and R. J. McCool, to recover damages for the alleged wrongful and malicious expulsion of the said Thompson from the Brotherhood, and the malicious publication in the Brotherhood Magazine that he had been expelled from the order for unbecoming conduct and violation of his obligation.
