The defendant, M. D. Miller, was charged by an information filed in the district court of Pontotoc county with the crime of selling mortgaged property without the written consent of the mortgagee; was tried; convicted; and sentenced to serve three years in the State Penitentiary; and has appealed.

The determination of this appeal rests principally upon the first proposition presented by the defendant in his brief, to wit: The evidence was insufficient to sustain the conviction. In this connection defendant contends that the evidence of the state showed that the mortgagee gave verbal consent…
