This suit was originally filed on the 18th- day of August, 1899, by James Cox against I. K. Watelsky and his sureties, for a breach of the conditions in his bond as a liquor dealer. In the original petition, and in the first amended original petition, which was filed on the 10th of October, 1899, the breach of the bond was alleged substantially as follows: “Plaintiff further avers and charges that heretofore, on to wit, the 27th day of April, 1899, defendant, I.
