OPINION

YOCK, Judge.

This action arises from the involuntary release of the plaintiff, Anthony J. Braddock, from active duty with the United States Army on March 1, 1978. The plaintiff now seeks reinstatement to active duty in the grade of major, correction of his official military service records, and appro*465priate back pay and allowances. The matter is currently before the Court on the parties’ cross-motions for summary judgment. The material facts are not in dispute.
