A motion was made to dismiss the bill of exceptions in this case, upon the grounds: (a) that a general demurrer to the original petition and the amendment filed June 7, 1926, the same being designated as the first count, was overruled, to which ruling no exception was taken, and which in consequence was a conclusive determination of the right of the plaintiffs to recover under said count on substantial proof of the facts therein set forth; (b) that the plaintiffs in error do not except to the final judgment and decree of the court; and (c) that while a general demurrer to the second count was…
