Appeal by the defendant, Banco De Tamaulipas, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 9th day of July, 1917, overruling its demurrers to the first and second causes of action set forth in the second amended complaint.

The facts upon which the two causes of action herein are based are set forth in the complaint as follows: The First State Bank and Trust Company (assignor of the claim in question to plaintiff) is a banking corporation organized under the laws of the State of Texas, and having its principal place of business at Laredo, Tex.
