SILER, Circuit Judge:
Subsequent to the publication by the previous panel opinion dated September 11, 2002, published at 304 F.3d 1312 (11th Cir.2002), the United States moved the court to amend the opinion to delete Section III.A, entitled “Allocation of the Burden of Proof.” Good cause having been shown, the original panel has granted the motion, withdraws the previous panel opinion of September 11, 2002, and substitutes therefor the following opinion.
