WHAM, District Judge.
This is an appeal from the conviction and sentence by the trial court, jury trial having been waived, of the defendants, Empire Packing Company, a corporation, and Samuel Chapman, its president, under an indictment brought under Section 80 [now § 287], Title 18, United States Code Annotated consisting of twenty-three counts charging said defendants with one Fred Sans, Jr., vice president and treasurer of said corporation, with filing false claims for Government subsidies with the Defense Supplies Corporation.
