Plaintiff Steven J. Gentile brought this action pursuant to 42 U.S.C. § 1983, against the Town of Orangetown (“the Town”) and its Police Chief, Kevin A. Nulty, alleging violations under the First, Fifth and Fourteenth Amendments, the Health Insurance Portability and Accountability Act of 1996, New York General Municipal Law § 207-c, New York Civil Service Law § 71, and New York Public Health Law § 18.
