This is an action of trespass on the case for deceit which was tried to a jury in the superior court and resulted in a verdict for the plaintiff. Defendant thereupon duly filed a motion for a new trial which was denied by the trial justice. The case is here on defendant’s bill of exceptions containing a single exception to such denial.
