DONALDSON, Justice.

The appellant, Jon Machen, appeals both the denial of his motion to correct his sentence which allegedly failed to give him credit for time previously served and the denial of his motion to dismiss the judgment of conviction.

Jon Machen, defendant-appellant, pleaded guilty to the crime of felony escape (I.C. § 18 — 2506) on November 4, 1976, and a presentence report was ordered. Machen was sentenced to an indeterminate term not to exceed five years; however, the district court retained jurisdiction for 120 days pursuant to I.C. § 19-2601. Machen was not represented at this…
